🔥 सबसे पहले सीधा जवाब

GPA Holder की मृत्यु मात्र से उसके Legal Heirs को उसी GPA के आधार पर अपने-आप Property बेचने या Registry कराने का अधिकार नहीं मिल जाता।

सबसे पहले यह देखना जरूरी है कि GPA किसने दी थी, किसके behalf पर दी थी, उसमें क्या powers थीं, Property में actual interest किसका था और transaction किस stage पर था।

GPA यानी General Power of Attorney एक ऐसा authority document है जिसके द्वारा Principal किसी दूसरे व्यक्ति यानी Attorney/Agent को अपनी ओर से निर्दिष्ट कार्य करने की authority दे सकता है।

“मेरे पिता की GPA थी, इसलिए अब मैं Registry कर दूंगा।”

यहाँ Buyer को तुरंत transaction रोककर यह verify करना चाहिए कि C के पास किस document के आधार पर authority है।

✔ Original GPA की copy
✔ GPA किसने execute की थी?
✔ Principal कौन है?
✔ GPA Holder कौन है?
✔ GPA की date क्या है?
✔ GPA registered है या नहीं?
✔ GPA में कौन-कौन सी powers दी गई हैं?
✔ कोई Agreement to Sell है?
✔ कोई payment proof है?
✔ Principal अभी alive है या नहीं?
✔ GPA Holder की death कब हुई?
✔ Death से पहले कोई Sale Deed execute हुई थी?
✔ कोई litigation / injunction है?

⚖️ GPA में Sale की Power लिखी हो तो?

यदि GPA में sale deed execute करने या registration-related authority दी गई है, तब भी केवल उस clause को देखकर पूरी transaction को automatically valid नहीं मानना चाहिए।

GPA की exact wording + underlying agreement + ownership/title + transaction की तारीख + applicable law — सभी को साथ में देखना जरूरी है।

🚨 “GPA Registered है, इसलिए Registry हो जाएगी”

Registered GPA होना अपने-आप में हर परिस्थिति में sale transaction की guarantee नहीं है।

Registration of GPA और transfer of ownership को अलग concepts की तरह समझना चाहिए।

🔥 अगर GPA पर “IRREVOCABLE” लिखा है?

केवल document पर “Irrevocable” लिखे होने से हर situation में agency का legal effect automatically तय नहीं हो जाता।

“IRREVOCABLE” शब्द पढ़कर रुकिए नहीं—यह देखिए कि authority किस interest से legally coupled है और underlying transaction क्या है।

📜 GPA + Agreement to Sell हो तो?

यदि GPA के साथ Agreement to Sell भी मौजूद है, तो मामला केवल GPA का नहीं रहता। Agreement की terms, consideration, possession, execution और parties के rights भी examine करने पड़ सकते हैं।

GPA + Agreement to Sell = Automatic Ownership नहीं।

GPA Holder की मृत्यु के बाद उसके Legal Heirs को GPA की authority automatically inherit नहीं हो जाती।
